Ideas for Peace Series – Right to Development
These publications present ideas from distinguished academics and scholars and discuss novel ideas in their area of expertise. On this occasion, the Ideas for Peace No. 15 presents “Towards a Legally Binding Instrument on the Right to Development” by Dr. Mihir Kanade.
In this publication, Dr. Kanade discusses how in less than 1.5 years, and after following a rigorous consultative process, the zero draft of the Convention on the Right to Development has already been published, along with exhaustive commentaries on each provision, and will form the basis for negotiations to formally commence among States for the eventual adoption of a binding treaty. As one of the main participants of this process, Dr. Kanade explains the context that allowed the zero draft to come into the light, discusses the added value of a legally binding instrument on the right to development, and considers the challenges and prospects that lie ahead with respect to the adoption and entry into force of the draft convention
Dr. Kanade is the Academic Coordinator of the University for Peace, the Head of its Department of International Law, and the Director of UPACE Human Rights Centre. He is also an independent expert of the UN Human Rights Council’s Expert Mechanism on the Right to Development. He chaired the drafting group mandated to prepare the zero draft of the legally binding instrument on the right to development.
